The law of insolvency is at nascent stage getting judgements on interpretation as well as amendment from government on daily basis. The applicability, scope, constitutional validity, timelines,various definitions, National Company Law Tribunal (NCLT) powers are every day getting enlarged or limiting due to sudden changes.

The insolvency resolution process revolves around a proposed resolution plan approved by committee of creditors having representation from financial creditors, operational creditors, workmen and statutory bodies. The Insolvency Resolution Professional (IRP) is supposed to act in place of the management till the time resolution plan is approved by committee, sanction by NCLT and fulfilled by the proposer or new promoter.
